obtained a defense verdict for a coal
preparation plant operator after a six-day trial in Raleigh County, West
Virginia. The plaintiff was injured while working on a coal drying
machine, which he alleged was improperly guarded. He further alleged
that the company knew the dryer was dangerous but forced him to work
around it nonetheless. The jury found that no unsafe condition existed
with regard to the dryer and that accordingly the plaintiff was not
injured as a result of the deliberate intention of his employer.
