Robert James and Phillip Glyptis
obtained dismissal of a case in Belmont County, Ohio where the plaintiffs filed suit alleging that a
general surgeon committed malpractice in perforating the colon during a
colonoscopy. Mr. James and Mr. Glyptis were successful in getting the
case dismissed after filing a Motion to Dismiss which argued that the
complaint was deficient for violating the pre-suit requirements of the
Ohio Medical Malpractice Act.
